CE Terms of Use & Privacy Policy

All NBSS Community Education classes are non-accredited and do not result in the award of academic credit. Students who complete Community Education classes are not considered alumni of the School and do not receive alumni benefits.

Students must be 18 years old at the time of the class. No students younger than 18 years old are permitted at this time, even with a parent or guardian present. We do not currently offer any classes for ages under 18, outside of our existing school partnership programs.

Please visit our class calendar to register online. Registration is complete once payment is received in full. Payment is due at time of registration. To pay by check or another source of funding, please email ce@nbss.edu. Class registration fees are per-person.

Waitlist
To be added to the waitlist for a Community Education class, follow the instructions on the class listing. If a spot becomes available, the spot will be released on a first come, first served basis to those on the waitlist. 

Gift Cards and Discount Codes
Gift cards can be applied at checkout. Additional balances may be paid by credit card. Massachusetts state law requires gift cards to be valid for 7 years after the date of purchase.

Scholarships and Other Sources of Funding 
There are currently no scholarships for NBSS Community Education classes. If you have been awarded a scholarship or have funding that you think may be applicable, please contact the Community Education Office. Some examples are:

• Veterans Association Post-9/11 GI Bill (for the Three-Month Furniture Making Intensive only)
• AmeriCorps Education Award

Cancellation requests received at least 14 days before the class start date will be refunded less a $45 fee. Refunds are not given for cancellations received within 14 days of the class start time. Registrations are non-transferable and NBSS does not issue credits. Students may not transfer registrations to another section of the same course, to a different course or to another individual to attend in their stead.

Cancellation policies for our Three-Month Furniture Making Intensive and Private Instruction classes are listed separately in each class description.

Classes that do not meet 50% enrollment one week before the class starts are canceled. Students are notified and will receive a full refund of their class tuition and fees only should this occur. NBSS is not responsible for reimbursing any other costs including but not limited to travel, accommodations, service fees, tool purchases, or time off work should a class be canceled.

Occasionally, classes are canceled due to inclement weather for the safety of our staff and students. Please note that inclement weather cancellations will be based on conditions in the Greater Boston area. 

Community Education inclement weather cancellations are announced no later than 5:30 am on the day of the scheduled class. Students will be notified by email of inclement weather cancellations using the email address provided during registration. Students can also check local news stations for school closings or call 617-227-0155 x300 for a recorded message.

In the event a Community Education class or session is canceled by NBSS, we will work to reschedule a makeup session(s). If that is not possible, students will be provided a prorated refund for the canceled class session(s).

Any individual participating in a North Bennet Street School class or program must abide by the following Code of Conduct, which includes an Anti-Harassment Policy and Reporting Procedure (see below).

NBSS is committed to providing an atmosphere where members of our community can learn, share, and support one another. Any individual participating in Community Education classes are expected to behave ethically, professionally, and civilly. Failure to do so may result in intervention and possibly expulsion from classes or programs.

Attendance
We operate on a common courtesy attendance policy. Students are expected to attend each class and arrive on time. If you are unable to attend a session or are running late, please notify the instructor or the school as soon as possible. Instructors will do their best to accommodate students who have missed class time. There is no expectation that the instructor will take time away from other students, adjust the curriculum, or that a student will receive extra 1-1 instruction outside of class time.

Communication
NBSS typically communicates with students via email and occasionally via phone for urgent updates. Please ensure you use a valid email address at time of registration. 

Cell Phone Use  
Phones should be turned off or in silent mode during class time. If you must use your phone, please do so outside of the classroom.  

Attire
This is a general list of how to dress for the shop environment, please contact the Community Education office if you have any specific questions or needs.

• Closed-toe, comfortable, and protective footwear (sneakers or boots)
• No loose clothing
• Long pants suggested
• No loose jewelry
• Long hair must be tied back

Building Security
Students taking in-person classes must enter and exit through the front entrance at 150 North Street and check in at the front desk each time they enter the building. Students may enter the building up to 30 minutes before class begins. Classes end promptly at the designated time and students are expected to leave the building at that time. Wandering into other areas of the building or self-guided tours are not allowed. Your instructor may give you a tour of the building or a specific program area if time permits.

Guests, Children, and Pets
Community Education students are not permitted to bring guests, children, or animals into the building. Exceptions will be made for service animals, please notify us in advance.

Accidents
In case of an accident during an in-person Community Education class, the instructor in charge will make the decision about the seriousness and the treatment of the injured person. Minor first aid supplies are available in all benchrooms and at the front desk. In cases of injuries requiring immediate attention or major accidents, the injured person must be transported to the Emergency Room at a local hospital. The instructor may call an ambulance from any School phone by pressing the 911 button. The NBSS Receptionist must be notified to either arrange for transportation to be ready, to call an ambulance, or direct first responders.

Drugs, Alcohol, and Smoking
Drugs and alcohol are not permitted on School property or to be used during online classes. Smoking, vaping and chewing tobacco is not allowed in the School building or near any entrances. Although marijuana has been decriminalized in Massachusetts, possessing it on School property is still prohibited. NBSS receives federal funding and therefore, must adhere to federal policies regarding marijuana possession.

Students who show signs of consuming drugs or alcohol before or during class will be dismissed immediately for the remainder of the day. Refunds will not be issued.

Anti-Harassment Policy and Reporting Procedure
It is the School’s goal to promote a workplace and place of study that is free of harassment from all categories protected by law including race, color, religion, creed, national origin, sex, age, ancestry, sexual orientation, genetics, pregnancy, marital status, gender identity/expression, disability, handicap, military obligations, veteran status, participation in discrimination complaint-related activities or any other category protected by law. Harassment of any member of the NBSS community occurring in the School or in other settings in which community members may find themselves in connection with the School is unlawful and will not be tolerated. Further, any retaliation against an individual who has brought up a concern regarding harassment or retaliation against individuals for cooperating with an investigation of a harassment concern is similarly unlawful and will not be tolerated.

While this policy sets forth NBSS’s goals of promoting an environment that is free of harassment, the policy is not designed or intended to limit NBSS’s authority to discipline or take remedial action for conduct which NBSS deems unacceptable, regardless of whether that conduct satisfies the definition of sexual, discriminatory or other harassment.

Definition of Harassment
Harassment is defined as unwelcome verbal, visual or physical conduct that expresses hostility towards an individual because of membership in a protected group, interferes with an individual’s work performance or creates an intimidating, hostile or offensive working environment.

Harassment can include, but is not limited to, verbal (including slurs, jokes, insults, epithets, gestures, or teasing), visual (including offensive images, symbols, drawings, text messages, social media posts, computer displays, or emails) or physical conduct.

Definition of Sexual Harassment
Sexual harassment is defined as sexual advances, requests for sexual favors and verbal or physical conduct of a sexual nature when submission to or rejection of such advances, requests or conduct is made a term or condition of employment or as a basis for employment decisions, either explicitly or implicitly, or such advances, requests or conduct have the purpose or effect of unreasonably interfering with an individual’s work performance by creating an intimidating, hostile, humiliating or sexually offensive work environment.

While it is not possible to list all circumstances that may constitute sexual harassment, the following are some examples of conduct which if unwelcome, may constitute sexual harassment: 

• Unwelcome sexual advances – whether they involve physical touching or not
• Sexual nicknames, jokes, written or oral references to sexual conduct
• Comments on an individual’s body or an individual’s sexual activity
• Displaying or distributing sexually suggestive objects or pictures
• Unwelcome leering, whistling, touching, sexual gestures, suggestive or insulting comments
• Discussion of one’s sexual activities

Reporting Concerns of Harassment
If any member of the NBSS community believes that they have been subjected to harassment, they should promptly report their concerns by contacting the Community Education office at ce@nbss.edu.

Harassment Investigation
NBSS will promptly investigate harassment allegations in a fair and expeditious manner. The investigation will be conducted in such a way as to maintain confidentiality to the extent practicable under the circumstances.

No Tolerance Retaliation
Retaliation against an individual who has brought up a concern about harassment and retaliation against individuals for cooperating with an investigation of a harassment complaint is unlawful and will not be tolerated by NBSS.

State and Federal Remedies
In addition to reporting concerns to NBSS, if anyone believes they have been subjected to unlawful harassment, they may file a formal complaint with the government agencies set forth below. Using NBSS’s complaint process does not prohibit them from filing a complaint with these agencies.

Disciplinary Action
Any individual participating in a North Bennet Street School class or program who exhibits inappropriate, disruptive behavior, out of line with the Code of Conduct listed here, will face action deemed by NBSS to be appropriate under the circumstances. For students, such action may range from receiving a warning, to being removed from a class or program, to no longer being welcome back to NBSS and may include other forms of disciplinary action as appropriate. For employees, such action may range from counseling to termination from employment and may include other forms of disciplinary action as appropriate.

Students are the owners of the work they produce in Community Education classes. At the time of registration, students agree to our Safety and Media Release terms. Video and voice recording are not allowed in any CE classes or programs unless pre-approved by NBSS staff. NBSS does not share the contact information of any of our students or instructors without direct permission to do so. For more details on student privacy and the information that is collected about individuals who visit our website or enroll in one of our classes, please see our Privacy Policy.

Intellectual Property
This policy defines the ownership and licensing of intellectual property created by staff, instructors, students and all others engaged with the Community Education department at North Bennet Street School (NBSS). 

Definitions
Staff: Administrators and student workers who work in the Community Education department or elsewhere at NBSS. 
Instructors: Those who teach classes in the Community Education department at NBSS. Instructors can be employees, full-time faculty, or contractors. 
Students and others engaged with NBSS: Students are individuals enrolled in classes or programs in Community Education at NBSS. Others are visitors or guests who may be engaged with NBSS in a less official capacity. 

Intellectual property
Any material that may be used in class and includes but is not limited to the following:

• Copyrighted material (content that is fixed and tangible)
• Patents (temporary exclusive rights to an invention or method)
• Trademarks (symbols, catch phrases, names of product or service)
• Trade secrets (recipes, processes, etc.)

Third-party content
Any material used in class that is not owned by NBSS or the instructor teaching the class.

Who is Covered: This policy applies to anyone who creates, contributes or generates content in preparation for or during an NBSS Community Education class or program. 

Community Education Staff and Instructors (contractors and employees) 
Students enrolled in Community Education Classes or programs
Any other individual or group that is engaged with Community Education at NBSS 

Ownership and Rights of Intellectual Property
For staff, instructors, and other class contributors:

NBSS CE instructors are the owners of the instructional materials they create independently of NBSS cooperation or direction. In cases where CE has provided payment to instructors to create class content or support through the co-creation of class content, purchase or loan of equipment or in providing post production, the materials are owned by NBSS. In either case, by signing an instructor contract, the instructor grants NBSS royalty free, non-exclusive, non-revocable rights to use the material in any format for use during the particular class and for promotional and marketing purposes. This policy does not transfer the ownership of any material created independently by the instructor to NBSS. Instructors remain the owners of any copyrighted material that they own and use in an NBSS class or program. 

Instructors are encouraged to use their own materials whenever possible. In the case that third-party materials are essential, instructors are responsible for identifying third-party materials to be used in NBSS classes in advance, ideally prior to the start of the class. Instructors are also responsible for identifying the source and the owner of the content. The sooner CE Staff is notified of the need to include third-party content, the more likely it is that the rights will be granted in time. There is no guarantee that permission will be obtainable, especially on short notice. 

If third-party materials are used unintentionally or instructors don’t realize until after class that they have included third-party content, CE staff must be notified as soon as possible. Those materials must be cleared in order to be included in a recording of that class that is made available to class members or other audiences, or for the materials to be used in subsequent class sessions or class offerings.

For students and others engaged with NBSS Community Education:

NBSS CE students own all material they create during their participation in a class. At the time of registration, students are asked to agree to grant NBSS non-exclusive, royalty free, non-revocable rights to use the intellectual property in any format and for any purpose.

Development of Materials for External Use
When teaching classes elsewhere or for themselves, instructors may freely use any content that they are the owners of as outlined above. For the use of any content that is developed in cooperation with or under the direction of NBSS, Creative Commons License terms must be followed.

Future Development of Class Materials
Instructors will be given the opportunity to review and redevelop the content of a class after the first offering and before subsequent offerings. NBSS may continue to offer and develop a class after the instructor who originally developed the content has ceased work at the School. NBSS may also use content across classes and for other future classes that have not yet been developed. 

Brand Endorsements and Recommendations: Brand endorsements and recommendations from instructors do not necessarily represent the views of NBSS.

Media Release and Personality Rights: At the time of contract signing, instructors agree to have their name, accomplishments, and hometown listed in publicity or press releases about NBSS. Instructors agree to allow NBSS to include them and/or their work in any photographs or video taken during the course of their teaching.

At the point of enrollment in each class, students are asked to agree to have their name, accomplishments, and hometown listed in publicity or press releases about NBSS. Students agree to allow NBSS to include them and/or their work in any photographs or video taken during the course of their training. Furthermore, students grant NBSS non-exclusive, royalty free, non-revocable rights to use the intellectual property created by them during their class in creating subsequent classes and marketing.

Student hereby acknowledges and agrees to the following with NBSS:

Safety Release
1. Acknowledgment of Risk: Students recognize, on behalf of themselves and any of their children under age 18, that participation in the NBSS Program involves possible health and safety risks. These risks include, but are not limited to, exposure to heavy equipment and machinery. Students understand that it is their responsibility to know and understand all safety precautions in the use of hand and power equipment at NBSS. When there is a question about the safe operation procedure of tools and equipment or when there is a question about the safe condition or malfunction of tools or equipment, Student will refrain from using such tools or equipment until they have learned proper procedures or have notified their instructor(s) of the malfunction and such malfunction has been corrected.

Student hereby expressly acknowledges and knowingly assumes all risks involved in or arising from Student’s participation in the NBSS Program.

2. Release and Hold Harmless: In consideration of the ability to participate in the NBSS Program, Student does hereby RELEASE AND AGREE TO HOLD HARMLESS NBSS, its Directors, officers, and employees, from any and all claims, liability, or loss arising out of Student’s participation in the NBSS Program. Student agrees to hereby RELEASE AND AGREE TO HOLD HARMLESS NBSS on behalf of their self and on behalf of Student’s Family, and also on behalf of Students and Student’s Family’s heirs, executors, administrators, successors, and assigns from any all safety-related claims, liability or loss whatsoever arising out of the NBSS Program, and waives any claim for damages arising from any safety-related cause whatsoever.

Students hereby release NBSS and all of its instructors and employees from all responsibilities in case of an accident incurred by their child or ward in the course of their child or ward’s instruction by NBSS.

Media Release
Students agree to have their name, accomplishments, and hometown listed in publicity or press releases about NBSS. Students hereby agree to allow NBSS to include them and/or their work in any photographs or video taken during the course of their training. Furthermore, Students grant NBSS non-exclusive, royalty free, non-revocable rights to use the intellectual property created by them during their class in creating subsequent classes and marketing.

To the fullest extent permitted by applicable law, all programs and services (as defined at the outset of these terms of use) and any related information or products are provided “As is” without warranty of any kind (express, implied or otherwise), including without limitation, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. North Bennet Street School does not warrant that any service will operate in an uninterrupted or error-free manner or that any service is free of viruses or other harmful components. Without limiting the foregoing, North Bennet Street School does not warrant that (a) the programs or services will meet your requirements or expectations or achieve the intended purposes, (b) the programs or services will not experience outages or otherwise will be uninterrupted, timely, secure or error-free, (c) the programs, services or information obtained through or from the programs or services will be accurate, complete, current, error-free, secure or reliable, or (d) any defects in or on the programs or services will be corrected. North Bennet Street School makes no representation regarding your ability to transmit and receive information from or through the services, and you agree and acknowledge that your ability to access the programs and services may be impaired.

Except insofar as the following limitation may be prohibited by applicable law, North Bennet Street School shall not be liable to you or to any third party for any consequential, indirect, punitive, special or incidental damages, whether foreseeable or unforeseeable (including, but not limited to, loss of profits or earning power, loss of data, losses due to errors or interruption in availability of any services, unavailability of any program, server or communications facility, or damages due to acts or omissions of others using any service or participating in a program), arising out of or relating to the agreements, the services or the programs, including without limitation your and others’ use of or inability to use any service, or your participation in any program, or your submission or use of user content, or others’ use of your user content, or your interaction with other program participants (whether online or in person), or your reliance upon information obtained from or through any program or service, whether based in contract, tort, statutory or other law. North Bennet Street School’s total cumulative liability to you arising out of or related to the agreements, the services or the programs (including, without limitation, in the ways described in the preceding sentence), whether based in contract, tort, statutory or other law, will not exceed the greater of (1) the total amount of fees received by North Bennet Street School from you or on your behalf for or in connection with the services and any programs in any twelve month period or (2) U.S. $100. The disclaimers and limitations set forth in this section shall apply, to the maximum extent permitted by applicable law, whether or not North Bennet Street School has been negligent or otherwise at fault.

You acknowledge and agree that the warranty disclaimers and the limitations of liability set forth in these terms of use reflect a reasonable and fair allocation of risk between you and North Bennet Street School, and that these limitations are essential to North Bennet Street School’s willingness to make the service and programs available to you. Each of these disclaimers and limitations is intended to be separately enforceable, regardless of whether any other remedy fails of its essential purpose.

For purposes of the foregoing disclaimers and limitations, as well as the indemnity below, “North Bennet Street School” includes both nonprofit and business entities, and its various departments (including but not limited to Community Education, Career Training Programs, Admissions, and Marketing), the members of its governing boards, and its officers, faculty members, employees, agents, contractors, and representatives.

Certain jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If the laws or regulations of these jurisdictions apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.

Indemnity
You agree to indemnify and hold harmless North Bennet Street School (as defined for this purpose in the Disclaimer of Warranty; Limitations of Liability Section above) from any and all claims, liabilities, damages, losses and expenses, including reasonable attorneys’ fees and costs, relating to or arising out of (a) your use or attempted use of any of the Programs or other Services in violation of the Agreements; (b) your violation of any law or rights of any third party; or (c) information or content that you post or otherwise make available through any Program or otherwise via any of the Services, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

This Privacy Policy discloses the privacy practices for www.nbss.edu, the primary website of North Bennet Street School. By using this website, you are consenting to our collection and use of information in accordance with this Privacy Policy.

This Privacy Policy governs our data collection, processing and usage practices. It also describes your choices regarding use, access and correction of your personal information. If you do not agree with the data practices described in this Privacy Policy, you should not use the Website.

Admissions and Registration information includes:
We collect and process information from you when you submit an application for full-time admission to North Bennet Street School, create an account on our Site, RSVP for an event, or register for a Community Education class. This includes but is not limited to Contact Information, Date of Birth, Country of Citizenship, Educational Attainment, U.S. Military/Veteran Status, High School and/or College Transcripts, and Letters of Recommendation, using third party compliant service providers.

Payment Information includes:
When you enroll in and provide payment for a Community Education class or purchase an item from our website, you will be required to submit payment information, including credit card numbers and billing information. North Bennet Street School uses third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their respective privacy policies. These payment processors adhere to the Payment Card Industry Data Security Standard (PCI-DSS), a set of requirements designed by the PCI Security Standards Council, a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. The current payment processors we use are:

• For public programs such as Community Education classes, we use Eventbrite, Square, and Shopify. 
• For store purchases, we use Shopify and PayPal.
• For online donations and tuition payment for our full-time accredited programs, we use Stripe and Diamond Mind. 

Transaction Information
North Bennet Street School automatically receives and records some information from your browser when you visit the site, such as your IP address, cookies and data about which pages you visit on the site through the use of log files provided by our third-party tracking-utility partners. This information helps North Bennet Street School analyze and understand how the site works for users. Information that is gathered includes, but is not limited to, information about how you interact with NBSS.edu, information about how you use NBSS.edu’s sites, email, other communications, and applications.

Mobile Location Information
If you have permitted your mobile or other location-aware device to transmit location data, North Bennet Street School collects Mobile Location.

No Information from Children Under 13
North Bennet Street School does not knowingly collect Personal Data from children under the age of 13 and is committed to maintaining the privacy of all children in accordance with applicable laws. If you are under the age of 13, please do not submit any Personal Data through the Site. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide Personal Data on the Site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to North Bennet Street School through the Site, please contact us, and we will endeavor to delete that information from our databases.
